Debitas legal services

Hi im new to all this, but recently i found it hard to pay my capital one card of only about £250.
they have passed me on to this company debitas legal services.
they are REALLY rude, and harrasing me all the time. i paid them £10 last week and made an arrangement on the phone that i would pay £10 a month as that was all i could afford.
I get a call today saying this was not an arrangement and that i mis-understood, when i told her no i didnt i am british i do understand my language!!!! she tells me it is not an arrangement and that i have to clear my arrears. i told her i do not have the money if i did i wouldnt be here in the first place! She then said we can give you 7 days to clear the arrears. in the end o lost my temper and told her to call back another day as i was sick.
Any idea what i can do / say as it is getting on my nerves now!! :mad:

Yes - stop saying anything to them at all. When they next ring refuse to confirm you are the person they are after, they then will not be allowed to discuss the account with you. And just hang up.

Then I would write to them stating that you can only afford £10 per month, ideally I would also ask for their bank details so that you can set up a standing order to pay them each month.
They may want more than £10 per month and may say they won't agree to it, but if that is all you can afford then that is all you can pay to them.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

Dont talk to them on the phone if you read most threads on here we nearly all agree only deal with them in writing they cant wriggle out of it then and only pay what you can afford they will threaten you with court action Debt collection agencies most of it is Hot air Im still trying to get them to agree my reduced payments 7 months into a DMP so try not to worry too much oh and they ask for proof income bank statements etc if you have not already done so do a statement of account or post it on here and someone will come along to help you then send it to them with your offer and wait to see what they do next0 -
You could try speaking to Julie Chilton at the executive response centre - 0115 843 3792. Debitas/Cap 1 did EXACTLY the same thing to me, set up a payment plan of £10 per month then disagreed it was a plan the following month! I went mad at them, wrote & complained continuously & finally spoke to Julie who was more reasonable than the others. She happily accepted the offer I made. She called me, admittedly, and I know the advice is not to speak to them but if you wanted to sort it out quicker I think this is worth a shot.
Still do as Tixy has said - write, pay by standing order only what you can afford. You need all this evidence to back you up should you need it. Cap 1 are horrible I'm afraid. Good luck!I've got nothing else but I've got my family.

Take careful note though - you set up a standing order to them - do NOT let them take your details and take direct debits from you. They could try to deduct the lot and leave you facing further charges or being skint.
They can't have what you haven't got!Some days, it's just not worth chewing through the leather straps....

I am in the process of setting up a standing order as we speak to them, i have got fed up with their calls, find it almost impossible to call them as I work all hours and have sent them a letter this morning offering to pay an amount back. However when I enter their bank details in my online banking it comes up with "surprise surprise" Capital 1, have put the name of the company as Debitas and made the first payment as I promised to do, will just wait and see what happens now.Cambridgeshire Based Photographer
