Litigation….

A certain debt recovery company (capquest) have sent me a letter saying

“As we have not had any contact with you we have been left with no choice but to start the litigation process”

What’s this mean and do you think they are bluffing?

    P.s the debt is for a capital one card and its £300 pounds (if thats any help)
  • has this been a long standing, quest for money... do you dispute the money owed.. still it sounds serious, but knowing, dept people, they are law to them selves best of luck lindann

    Is this your debt? Do u definitely owe this amount? If so send then a letter offering payment and they'll shut up. They are very unlikely to take u to court for £300 but it has been known.

    Actually, how old is the debt? When did u last make a payment?

    no payments have been made its about 9 months old i think the best way is to do a 10 a month jobbie.

    If you are happy that the balance is correct and its your debt then I would write to offer a monthly repayment. If you are not sure of either of those points then I would start by sending the prove it letter.

    Its unlikely they would take you to court at this stage for that amount but is possible, so if you do owe it then it makes sense to start repayments anyway.
