Tribunal chance?

    You lost your job by bunking off early.

    You have shown us no evidence of informing your employer you were disabled or asking for adjustments to be made.

    You have shown us no evidence of your trying to mitigate your losses by finding other employment.

    Your tale sounds very bitter and twisted and not entirely logical.

    I have worked in HR for a long time and I rate your chances as zero based on what you have told us.

    Do feel free to offer further information to help us understand why you think you have a case.

    This company have ruined me financially made me sell my house to repay remortgage and warped my brain with stress unimaginably and made me come to live in a horrible filthy town with weird people totally alien to my lovely town I lived in all my life.     On 26th September this year -in other words, three weeks ago - you had not even made a tribunal claim. If you had immediately submitted a claim on that day you would, by now, have received nothing but an acknowledgement of the claim, and might, if you were extremely lucky, have received a call from ACAS. Do you think we are stupid? No tribunal will accept a claim that is two and half years old, no matter what you say. Being ignorant of the law and the ability to make a claim is not even accpted as a reason for being a day late, never mind years late. A pre-hearing review takes months to schedule. Many people don't get one for 6 - 9 months - and that's after the CMD which you haven't even had yet!!!

    I smell troll. Get a life and don't come here abusing people who were kind enough to try to help you, with your snarly behaviour and nasty ways. I'm sorry if you lost your job - zzzLazyDaisy nor anybody else here weren't responsible for that, so don't take it out on them.

    Why are they accepting a pre hearing then?

    Course Im bitter after all the above all I tried to do was pay my reomrtgage and do a good job.

    Not my fault my leg froze up after 7 hourse what do they expect hiring me and another thing is they told me to go same day and never gave me notice.

    Even so Im sure the national papers will like a story of a major company caring they say for their employees on the website, yet ruining someones life the other hand.

    Then I will leave this UK never to return I should not have three years ago.

    look, you AGREED you could manage the work with painkillers. Your employer is not psychic! If you do not tell them you are disabled theyy can't make adjutments for you! Sounds like you fibbed about your ability to get the job and now you are complaining that you were treated like the fit and able person you presented yourself as being - well, you cannot have it both ways.

    Almost every week someone comes on here mouthing off and declaring the national press will have a field day. Yet to see them give a monkeys about any of these small individual cases on shakey foundations, but feel free to have a go! here's a link forr the Sun. Let us know if you get into print!

    Pinktooth - you are a complete and utter fantasist. Please, do not make me laugh - scheduling a pre-hearing review within three weeks of making a tribunal application. Complete b!!!!y rubbish.

    Here's the facts. If a tribunal claim is out of time by one second then the tribunal refuses jurisdiction. They write to both parties to say this. If the claimant then refuses to accept this and the claim is three or less days out of time, then the tribunal asks for an explanation and may order a hearing if the explanation is within one of the valid reasons for lateness. This applies in all cases except discrimination claims, where the tribunal has the ability to order an extension to the deadline to a maximum of six months ONLY if the reason for the delay was that the claimant was attempting to resolve the matter through grievance procedures. A claim that is more than that is automatically refused except in one circumstance - where the claimant can show that they have been unable to make a claim due to mental illness and has been hospitalised for the period during which they could have made a claim. Even then, a claim two and a half years later would not be allowed.

    The reason for this is because any judgement whatsoever would immediately be referred to an EAT because the tribunal has no power to act in extending its juridiction. That power does not even lie with an EAT or the Supreme Court. It lies only with Parliament who would have to change the law.

    The only place that you have a "pre-hearing" is in your head. You just think that you can make yourself big and important by making stuff up and pretending it's true. Here's a news flash - you are making yourself appear pathetic. As does blaming your employer for hiring you in the first place. If they hired you, what they expected was for you to be in work - because that's where you told them you would be. It wasn't up to you to decide to go home early, and it wasn't up to you to tell the other staff that that was what you were doing.

    I'm sorry that you had an injury and that it has affected your ability to work. But what you did was wrong - regardless of what the employer may or may not have done, you were wrong. Employees don't just decide to up sticks and leave work without their employers permission. Making up stories for a bunch of strangers on the internet, and then being nasty to people who tried to help you to make yourself look important two and half years later only shows that you need help. And it isn't our help you need.
