Court Papers ?

Mornin all.

Recieved papers yesterday from accrington courts, saying, please find enclosed the claim forms for the possession claim issued against you by NR.
You can respond to this claim by visiting the website, or you can fillin the attached defence form and send it to the court.

As me and the wife move out of the house in april and we want it reposessed, do I need to fill the paperwork in, or can I just send a letter to the judge stating we dont appose the repo.

Other letters that have come through from NR also state about costs we will incur for the sale of the house and court costs, are we liable for them, and finally lol once the judge gives NR possession of our house does that make them liable for the council tax.

    Sorry, i can't really say much to help you. Have you already gone bankrupt? I personaly would'nt speak to NR under any circumstances, don't acknowledge them, but state your case to the judge, i.e. write a letter,take some impartial, free advice from one of the advice agencies, and go to court, if needs be,

    I'm sure somebody else will be along with more helpful advice.

  • I wouldn't respond to them. You can write to the judge and tell him to grat repossession or you can just do nothing it's up to you. If you don;t show for court the judge may adjourn or may just grant reposession.

    With regards to the council tax, as soon as NR have been granted possession then yes they are liable for the council tax. If the house is empty at the moment you can apply for exemption which I think covers 6 months, or if you are already BR then you can get exemption as the property was left by a BR and is now under the trustee. Either way, I don't think you should be paying council tax on it. I am sure someone will be along later and correct me if I am wrong. When we left our home we didn't pay council tax on it.

  • Thanks for the replies, we are both BR since April, think ill just send a letter to the judge instead of filling in the forms they have sent us. do I need to include our BR ref numbers so they know why we are no longer in our house.

  • You could include your BR ref numbers as the judge may pass them onto NR.
