csa penalty assessment

The csa penalty assessed me in 2005 when i was on benifits.The total is £3797.56 and when i was working back 2008 they asked my boss to take £265.32 a month witch he did i have the wage slips to porve it and the bank statements form 2005 to prove i was on benifits. Now they are going down the court road. they whant it all now and the money i have paid. They whant again as they say my ex boss did not send it. Any help would be grate. thanks.

you're not alone. a boss has recently been jailed for failing to hand the money over from a DEO he took from an employees wages. the only legal recourse would be to sue your old boss.
the bad news is, that as far as the nazis at ze csa are concerned, they haven't had the money from you, so in their infinite wisdom they will continue to chase you for it.
the best advice i can give you is to get your MP on to the case. also, NACSA are ace at sorting out csa messes as they know more about the csa laws than the morons that work there.
i think it's £50 membership, but worth every penny and more as they tak over for you. a must if you don't know the system if you have them buzztards hounding you.NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.

How can you furnish wage slips if you are on benefits?
So then you are on benefits and somehow obtained some massive arrears (incidently about 1 year of wage slips worth) ?
You are supposed to inform the CSA of change of circumstance (if you did I would get someone else to check the forms and letter before you send them off, as there are a lot of errors in your grammer etc) . If the csa agents are reputed to be not bright , how can you expect them to decipher what you post?

I'm just inviting the OP to clarify the story, as whilst some say I'm anti PWC, this does seem a case of an NRP trying to blag the system, hopefully I'm incorrect

So do you agree that you owe some child support financial contribution for 2008?
All the NRPs I know get an annual statement, so I'm still confused why you never noticed that the statement was not showing that the csa were not in reciept of your contrbution.
Perhaps a case via Nacsa may be worth consideration.0 -

Ok , 1st things 1st, if you had a penalty assessment made in 2005, wherey CSA wanted/assessed that you pay £146.35 per week, yet you were on benefits and only had an income of £56 per week, what I advise you do, is request in writing (recorded delivery of course) that the Interim Maintenance Assessment made in 2005, be converted to a Full Maintenance Assessment, you will need to ask them what specific information they require to convert this penalty assessment (IMA) to a Full Maintenance Assessment.
They should tell you exactly what they need, you provide it, and then they will either convert the IMA to a FMA, or refuse. If they convert to FMA, great, the penalties will be removed, thus a lesser assessment (probably approx £5 per week, whilst you were on benefits), if they refuse this gives you appeal rights, and you can then demand an Independent Appeal Tribunal whereby everything will be heard by an Independent Judge, who will make a decision

Also, complain (in writing recorded delivery), involve NACSA, and MP as others have advised with regard to proof you have that employer must have failed to hand over CSA monies that were taken at source from your wages0

I just think you're not reading it properly. How would the OP have a DOE set up, with proof by way of pay slips, if he had never informed them of a COC.
It sounds more like an error by the CSA or his ex employer than a dodgy NRP to me.
