Is it too late for Early Discharge?

My husband became bankrupt in Feb this year. For various reasons he failed to return the IPOQ form to the OR within the 14 days required. The form was eventually returned on about 26 days after receipt.
We sent a letter explaining why it had not been possible to return the form within the time frame but have now received a repsonse stating that as the IPOQ was returned late (turns out they actually allow 21 days anyway) the OR will be unable to proceed with ED.
Does any one know if this means that my Husband will definitely not now get ED and will have to wait until Feb 2011? Hubby looks after our 2 year old son full time so does not go to work currently and I have a full time job and pay for all our household expenditure. Unfortunately I am shortly to be made redundant and so we really need for my husband to return to work in the immediate future to tide us over. ED would have meant that he could return to work with no repayment order hanging over his head as he has not had this put in place by the OR to date based on having no income.

Hi rorosmummy, Unfortunately even if you did get the IPOQ form in on time it doesn't guarantee you would get it......as I know a lot of people on here who have filled in several IPOQ forms and ED didn't happen. So sorry it's enigma who get's it and who doesn't I'm afraid.

Agree with what if says above, even if the IPOQ is returned in time it is no guarantee but as you didn't return it in time then I would think it is a definite no. It does clearly state on the letter that if it isn't returned on time then that is that. When ours arrived I completed it and sent it back the same day to make sure that nothing happened to prevent it getting returned.
If your husband gets a job then all the outgoings will be from his wages if you are not working so he still might not get a payment order anyway, and to avoid getting an IPA is not really a good reason to not work is it?0 -
