Historical Debts and Mortgage

Hi

My history is back in 2006 I had a few credit cards, a loan and an overdraft. I was struggling paying them all so set up a payment plan with Payplan without whom I would now not be completely debt free.

I have since got married and we are looking to move house. I have never had a mortgage before and have warned my husband that my history may effect us getting a joint mortgage. I got my credit report through the other day just to check that everything is in order and 2 of my old creditors are showing defaults against my maiden name. I haven't ever missed a payment but the defaults are listed when I started using Payplan to pay my creditors so think that they are related to that. I have written to both creditors to ask for evidence of these defaults.

One has said that the default would have been computer generated so they can't show me the default letter but that they can't do anything else to help. The other says that because the account is paid off they are not under obligation to send me proof of default from that time!

Is there anything I can do to find out why they have filed defaults against me? Is it likely to be because a few payments were late because of Payplan and less than I was paying per month (even though the creditors agreed to my new payments). Also can I ever get these defaults removed from my credit file?

Thanks
Claire

The defaults will have been added because you didn't keep to the payments you originally agreed to. Although they agreed to reduced payments during the DMP they will usually default you as you have broken the original contract. The defaults won't necessarily have been anything to do with late payments via Payplan.

I'm fairly sure that they are obliged to send you a default notice but someone will soon tell you for sure.
  • You could ask them to see if they would remove them as you have settled them however, they are unlikely to do this.

After 6 years (so in 2012) they will be classed as spent or satisfied and hopefully after this date it should be a bit easier to get credit.
