Mortgage help required/ split with OH

I have posted a similar thread on the child support thread but it may be better to do it here? sorry If I ramble, in a nutshell this is my problem,

I split from my OH after 23 years for many things however one of the main things was that he destroyed our joint finances to such a degree that he petitioned for his own BR in Aug 2009. At this time I still was believing of him {yes I know stupid!} He had handled all our finances and I did trust him and when he said there would be no need for me to go BR again I believed him. It was only when in May of this year that I found out that a secured loan had been taken out on the former {joint mortgaged family home} this then pushed up the debt to around the 550,00.00 mark on a house that is probably worth 470,000.00 in today's market. Thus leaving a shortfall. Now this shortfall will be covered by his BRuptcy therefore I was advised to also file for BRuptcy otherwise I would be liable for the whole debt.

Ok so now we are both BR I have my two girls in rented accomodation and have put in a claim to the csa as he is not supporting his children aged 2 & 7.

However he is still paying the mortgage on the former family home having rented it out without my knowledge. The building society hold a possesion order on the house {obtained without my knowledge} ex OH had hidden all the paperwork and had the post redirected to his place of work {for years}.

Has anyone any ideas of what I can do if anything? I understand he is living with someone, he won't give me a contact address except for work I am at a loss really......hope I have put in all the info I have just seen the clock gotta run to school....If anyone can help I would be most grateful.

    Yes mortgage is in joint names

    When you seperated what was the arrangement with regards to the property?

    Does your trustee still hold a benficial interest in the property?

    Hi again, there was no arrangement he just took it upon himself to get tennants in. In Sept 09 the OR wrote to me to ask if I wanted to buy the BI {his} , I was in no position to and then it all went quiet.
    After my bankruptcy in July, my OR said I could buy my BI ? but what is the point, I can barely afford to look after my children, so yes at the moment my OR has the BI in the property.

    Then if he's letting the property out and the mortgage is getting paid then. If at some point in time in the future there is equity in the property then you will receive your share. As the property cannot be sold without your permission.

    Through the CSA you can obtain your share of the rental income. Just ensure they are informed.
