CAB Have dumped me right in it

Hiya, After leaving my ex, I struggled financially. After burying my head in the sand for a while I realised that enough was enough and I needed help. I went to the CAB who lifted a weight off my shoulders. Once the paperwork as signed and handed over they advised they had contacted ALL my creditors. I continued to recieve letters from my creditors and calls but each time I told them with confidence the CAB were dealing with it and please leave me alone they will be in touch. I contacted the CAB who said yes everyone has been contacted but if they choose to ignore our letters there is not much we can do. Anyway I began paying reduced fees to all but one of my creditors who the CAB had said had not replied. In October 2009 I got a Summons to court which I took to the CAB. Again they talked me through what to write as my defence and told me not to worry. My paperwork had been filed and I was told to see the duty solicitor at the court on the morning of my appearance. I have never been in trouble before never mind been to court so as you can imagine I was in a hell of a state. I asked the CAB to provide me with paper evidence of the letters they sent so I could at least show them that I had been getting help and they had ignored my pleas. The CAB rang me that afternoon and said oh by the way we didn't contact them. We forgot! After the amount of calls and letters I had saying not to worry they had been contacted I was now being told they hadn't bothered. :mad: I don't have any money for a solicitor and I have written to them on many occassions and either do not get a response or a letter saying not our fault. I have it in black and white that they admit responsibility for this. Where do I go from here? I have a CCJ and also a letter from my creditor that if CAB had contacted them with an offer they would have accepted it. Can anyone please help me? I feel like I am banging my head against a brick wall!!

  • Oh and there was not a duty solicitor there to help me as it was not a criminal case.

    Indeed it was a civil case.

    What was the outcome?

    What are the debts for loan credit cards etc?

    When did you take these out?

    What was your defence that you filled out?
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    I agreed to a lower payment but I now have a CCJ against my name.

    This one was for a personal loan taken out for a motorbike to get me to and from work. It was taken out 18 months prior to me contacting the CAB in January. My defence was based on the fact I had been suffering from PTSD at the time I asked the CAB to deal with my debts as I wasn't mentally strong enough to be doing anything myself. I am through the other side now and am willing to fight. I understand I was not entitled to a duty solicitor but was advised by the CAB I was. Unfortunately now they will not answer my letters and I don't know where to go from here.

    How much do you owe for the CCJ?

    Has it been recently?

    You can go down 2 routes

    Remember though, a judgment is only taken off the Register of Judgments, Orders and Fines if:
    • you paid it in full within one month
    • it's set aside by the court (see 'If you disagree with a CCJ' above)
    Pay it all off in 1 month

    Go down the setaside rule and give the reason that CAB were crap
