Please Please help

:( Please Please help, I have tried to sort this problem for the last three years and just come up against a brick wall every time. In 2002 I took out a personal loan with RBS. Soon afterwards I got into difficulty financially after my divorce and I consulted the CAB who arranged lower monthly payments with RBS which I have been paying ever since. After a period of time I was contacted and advised that my payments should from then on be made to a firm of solicitors. The problem started in November 2008 when I asked to see the original loan agreement, after about a week of waiting I was told by RBS that these have been lost. My problem is that I dont know how much I originally borrowed, what the APR was, what it is now, how much I have paid back, I have NEVER received a statement. Whoever I contact, be it RBS or the solicitors they just tell me to contact the other.


I also reclaimed the ppi on the loan but again this was shrouded in mystery and I was told it was used to pay off some of the loan, I have no idea how much etc.
I understand that legally RBS must have the original paperwork with my signature in ink on it, if the cannot provide this and the fact that I cannot obtain statements etc, where do I stand legally? I cannot afford a solicitor so what can I do?

Please please help, i am at my wits end.

    Hi there and welcome.If i were you i would send rbs £1 and ask for your agreement, tell them if they do not comply with request you will take it to the fos, i would also now, put a complaint into fos regarding this agreement and the ppi, they had no right taking this off the loan without asking you. You may get others who will have better advice and i am sure you will get all the help you need. Good luck. Btw rbs do not have to give you the original agreement signed in ink a copy will suffice,if this loan is in arrears then they will have the original, as the loan is in effect still running.
  • Hi thanks for taking the time to reply, I have already requested the paperwork concerning this loan but they have told me that it has been lost. No one seems interested in helping me
