CCA request: Capital One

Hi,
I have a been paying token payments on a Capital One debt for 10+ years now (after suffering from cancer and being unable to return to work). They refused to accept my Statement of finances a few weeks unless I produced copies of bank accounts etc. When I refused to do so they sent me a Default Notice and passed debt to Capquest to collect.
After taking advice from helpful posters here, I sent Capquest the standard CCA letter. I received acknowledgement of receipt from Capquest, then just before the 12+2 days were up, I received a letter from Capital One saying they would be unable to provide the information I had requested for up to 28 days.
What do I do now...just wait until they come up with the CCA?
Many thanks!

  • Its a usual delay tactic employed by many of the DCA's which they use to either never supply the cca or reproduce some shoddy copy of one which they'll expect you to accept;)

I for one would keep paying the 'token payments' you are making as I'm sure they are accepting these, and if the worst was to happen you can prove that you have been attempting to pay this debt off, even though its not the monthly amount that cap1 want:D

Yep, buying time while they rifle their barn full of documents.

Stop paying, that should make them look quicker.
