is there anyone who can help me
i have lived in my home for 25 years also at this address
i ran my business
in 2002 my home and business was devastated by vandalism
in which my children could have died
i had to borrow 20,000 to have the measures done to keep us safe
in 2005 nat west bank said what are you going to do about this
large overdraft
they said to put it on to a loan which i did but they reduced
my overdraft so low that i could not survive
i then contacted business link who said why did nat west do this
it should have been put on long term loan at the time they have made you use your working capital which you need to run the business
it could have been added to your mortgage as it was low
we nearly died so i would have signed anything
i have since seen a solicitor and it was professional negligence
and non duty of care but because it is a business i cant have
legal aid to sue them
they have ruined me i have tried to keep going but the only
option i had was to lease the business out
great this would solve all but the mortgage company
i have and other charging orders have taken to long to give
permission to lease so the person has pulled out
so i now have large mortgage arrears which would have been
paid by the leasing of the place
now time is running out we face eviction i am just a single
parent with 3 children and an 82 year old father to care for
i now know my mortgage has gone down to so low that i can afford it and plenty a month off the arrears but they wont budge they want the arrears in a lump sum
i cant do that, nobody will help me as nat west ruined my perfect credit history
does anyone know of anyone who can help

the banking code states they haave a duty of care to deal well with people with arrears - overpaying to reduce the arrears seems reasonable to me so they should take this offer.
a judge will not rule to evict you if you are taking reasonable steps to bring the payments up to date. They cannot evict without a court order.
Please, do not panic. Try CCCS as noted above, and perhaps also Shelter.Debt free 4th April 2007.

Google "mortgage pre action protocol", this will list the actions a lender must follow before they can take you to court. If they don't follow this, they don't have a leg to stand on.0

i have been to all
shelter are helping with court
it has been to court we have an eviction notice for 5th oct
i have tried all ways but i need a loan to pay the arrears to them in a lump sum they wont stop the eviction without a lump
sum and no one will lend to me even as i can afford it now
this judge will hold are life in his hands
shelter said because the arrears are high there is a great risk
she had 3 evictions on monday in which she tried to help stop
they will except a lump sum of, but i have to say the amount
they wont say an amount to stop the eviction
it has to be all or an lump sum offer
i cant do that i can only do it over each month
i need a loan this seems to be the only way0 -
Sorry but a loan now sounds like it will just give a short period of grace before it all comes crashing down again in a few Months.
With 3 children you are not going to find yourself on the street. I would hope Shelter informed you of this.
It will be difficult for a while but this really isn't a case of anyone having your LIFE in his hands.
In 6 months/1yr you may look back on this as a good thing, all the stress of this is understandably unbearable. Sometimes it is best to walk away and start afresh.
Sounds like you have people relying on you, keep your chin up no matter what happens and be strong for them.

thank you but i dont intend to lose my home
now the mortgage is so low i can easily afford a loan
or plenty to the mortgage company they just wont listen0
