Hi All,
I was so please last week getting on top of my debts. Just had a letter of Hsbc telling me my over draft was £188.00, last week it was £95.29 !!I was going to pay this off in full feeling really proud but now with all the charges I dont know if I can ! Fees and Charges = £50 Interest+ £7.00 . I paid £700 last week to try and clear it ! I am so angry but will pay it in full tomorrow and live of beans so be it. Good news I think Mbna phoned me today and for once were quite helpful, strange really because they have made my life hell over the last few months. I have made a token payment and wrote a letter explaining I will pay £200 per month that is £50 more that what I was paying before. There is £505 in arrears but I cant afford to pay that off ! They are phoning me Monday and I will not give in that is all I can afford. Still thinking about asking for a CCA as it was taken out in 2002 ! but dont know if that is still credible with new laws ? I know they are going to hound me for the arrears but think that £200 is reasonable and any court would think so too. So to hell with them I will take my chances. Any advise please

First of all well done on making such a big dent in your debt (try saying big dent in your debt after 6 pints)
Seriously, its a huge effort you have made to clear your overdraft.
Have you tried calling HSBC and asking them if, as a gesture of goodwill in light of the fact you are trying to get back in the black and your recent £700 payment, if they would waive the charges?
Don't ask don't get.
Interesting to hear about your experience with MBNA. They called my OH the other day suddently very keen to discuss a payment plan in line with her I/E (something they have refused to do for almost 3 months instead demanding full payment).
Coincidently (I'm sure :rotfl:) we had CCA'd them at the beginning of the month and they replied stating they didn't have a copy of the original agreement.......
Its your legal right to request a copy of your CCA, that is why there is a process and a fee for it so I don't see why not.
What you choose to do depending on their response if of course up to you after that point......

You should definitely request the CCA, letter (if you need it) here...

I bet you your whole balance that they won't be able to find it and you will find that they are a lot more agreeable to your offers of payment once they realise that you know your rights. Of course, if they don't have a valid CCA, what you do after that is entirely up to you
Also, pay off that overdraft asap but ring them and get an up to date balance before you do. I can remember trying to pay off a Natwest o/d many years ago and every day that I went to the branch with the last £10 or whatever they told me there were more charges. I eventually had a tantrum, demanded to speak to the manager and told him that I would pay no more and that he better close the account today or else I would contact the newspapers. He did close it funnily enough ....aaah, those were the days!"I may be many things but not being indiscreet isn't one of them"0 -
Thanks for the advise guys. I will wait and see what Mbna have to say to me monday and if the response is good then I will continue to pay my debt of if they charge a resonable amount of interest as well. If they dont like my payment offer and wont reduce the interest then I will request a CCA which I know they dont have and see what they come up with then !! Im quite excited at the prospect of haggling with Mbna .Never thought I would say that ! I will talk to Hsbc and try get them to drop some charges on my o/d and i will pay that in full then. Thanks again let you know what the outcome is.
Mbna 10,238.33 reduced to 9,738.33 in one month.(26.6)its going to be a long haul
Halifax 1,582.06 reduced to 1,347.06 in one month (15.9)
Hsbc Loan 8,953.91 reduced 8,771.44(8)
Hsbc o/d 795.29(19.9) reduced 95.29 now gone up too 188.99 !!0
