Debt After Death

Hello

Just wondering if a person in debt dies or dies during bankruptcy. Does the debt die with them or can creditors/court still claim from estate, death in service benefits etc.

    I think they will try and write it off but please don;t quote me on it.Someone will be along soon and let you know.

    Debts must be paid from the estate. If there isn't enough money to pay the debts then they die with the debtor and can not be passed on to next of kin.

    When my dad died in February, he left a couple of debts behind that weren't connected to my mum (they were in his sole name).

    They were a credit card with the Halifax for £1,000 and a LloydsTSB credit card for £8,000. My mum and dad also had a mortgage which obviously my mum has carried on paying.

    My dad had no other assets apart from the house, he had no savings or anything like that so he didn't have an estate to speak of (he had some pensions but they pay out a monthly income to my mum).

    Our financial advisor wrote to the companies asking them to write the debt off and they both did without argument.

    Technically they come from the estate. If they are smallish debts the cerditor may choose not to pursue them, but this is not always the case, and not a right.
