Deduction from earnings for 21 yr old?

Hi, I was contacted by the CSA in early 2010 and informed that I owed £4500 in arrears, covering the years of 16 to 19 of my daughter. They informed me that she was in full time education during those years, and as I was allowed no access to her at that time, I cannot offer any proof to the contrary. I asked the CSA to provide proof that she had been attending school in order to assure me I had to pay the money. Amazingly, it would seem, they do not ask the parent with care for any kind of confirmation of this type. I know from details she entered on an internet site that she was in full time work for at least one of those years. No surprise that when offered to the CSA. it was dismissed as insufficient proof. Personal Privacy Laws prevent me from getting any evidence to prove one way or the other, and her mother has already received this money and will help in no way. Citizens Advice are at a loss as to where to go next. Letters to my MP simply receive answers that all is sorted. It is only sorted because they feel it is OK to instruct my company to remove £43 per week from my £120 part time earnings to leave me with less than £80pw to live on. I see no way of correcting this, in my opinion, illegal action against me, except to live in poverty for the next 2 years and pay up. However, should anyone know of another course of action, I would be very grateful to know what it is. Thank You.

Unfortunately this is commonplace.
If you have shared custody of the child, and know which college she attended, you can request a copy of attendance record/enrolment etc. mMay be worth trying to ask CSA to do benefit check on PWC for the period in question (from 16-19yrs), as they often do benefit checks, and if PWC not paid Child Benefit for that period, then they will tell you no CS Liability. CSA will also tell you if PWC received CTC for the same period.
Good luck, but of course, it has been known for a minority to claim CHB etc even if child/ren not studying0 -
Thanks for the advice btd. However I have not even seen my daughter for the last 8 years therefore custody not an issue. Rumours coming to me at the time (16) were that she was working at a vets as she loved all animals. I asked csa to carry out a benefit check on PWC and they politely told me it was not their responsibility to prove anything. They do not even have any proof of her college attendance. They told me that as I had not told them of her working and the PWC had not done so, then they just continue to hand over maintenance. As I had no communication with csa, I was not made aware of this fact for almost 5 years, so I had no opportunity to investigate at the time. Regarding communication with PWC, I know I would have more success tormenting a scorpion. She would claim anything she could get away with for as llong as she were allowed to. In this case, that was 3 years. Thanks though.:beer:0
