Baliff and unpaid Attachment of earnings

I came home yesterday to find a letter from a Baliff company regarding our unpaid Council tax, First though was sheer panic, second thought was, Hang on we are paying by attachment of earnings from Hubbie's wages. So after a whole night of no sleep,first thing this morning I went to the Councill offices to find out that although his employer is taking out the money for the attachment of earnings, they are not paying that money to the Council, who understandably send back the Baliffs. I am so angry, If I had been home yesterday the Baliff would have been able to levy distress on all of our belongings, just because the Boss hasnt paid the money he has been collecting.
I am so angry, I dont know what to do.. I feel like going to see his boss and letting rip but I know that I cant as he may lose his job. Has anyone else ever had this situation and what can I do? He is on holiday in the States until next week so the Council cant speak to him about it until then.

Big things to sort out but today is the start of recovery and way to a new debt free life.

    Ive seen a few cases like this and where the person has been able to provide proof that the payments were taken we have given them a re-payment arrangement over the longer term, or if the business has gone bust, considered the amount for a writeoff.

    Unforunately its one of those cases where the council can pressure the employer but cannot force them to hand over the money, you would need to take out a civil case against the emplyer.

    Are you certain the money hasn't been paid and just hasn't been paid across correctly ? - you'd be surprised at how many people send money without any form of reference and its held in a suspense account until it can be paid to the correct account.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
