Help required - RE: Bank lending criteria

In a nutshell I have an 'Arrangement to Pay' notice posted on my credit file by a certain Bank...However, this item was posted on my credit file in error by the bank which has since admitted their mistake and agreed to amend my file.

This admission of error was made in February and although my Experian file has been corrected, my Equifax file has not.

After a lot of waiting and much correspondence i decided to make a claim against the Bank as i have been refused credit on many occasions which I elieve is a direct result of the 'ATP' notice on my file, as the rest of my credit file whilst not immaculate, is pretty good in all honesty but for 1 or 2 late payments over the years.

My claim against the bank is now in the hands of the Fin. Ombudsman, who today telephoned me to say that I need to be able to show that a refused loan or credit application resulted fundamentally because of this ATP notice.

I telephoned my main bank who I have in the past been refused a loan by if they could give me a written statement saying what I believe to be the case - that the ATP note was the downfall in my application.

The guy on the phone explained that he would be unable to help and suggested that no bank would disclose their lending criteria as this could be a gateway to potential fraud...I then asked him off the record if he could give me an answer yes or no - 'If I applied for a loan or credit card and during the application process, the bank checked my credit file and saw an Arrangement to Pay item posted on it, would that qualify for an instant refusal for credit?' To which he simply replied Yes.

I am therefore stuck as I don't know how I can prove to the ombudsman that I have been repeatedly refused credit because of this ATP notice, since no bank will discuss their lending criteria.

I would ask any of you in a more prominent position than me for advice on how I can acquire the proof I need to present to the Ombudsman.
