Me again!!

Hi all

I hope someone can help? I want to write to all my creditors and ask for an updated statement of total outstanding, plus a breakdown of all payments made. Is there a standard letter template that I can use please?

Also I note that many people on here have also asked their creditors for a CCA...........please can someone explain what this is?

Finally I posted earlier too and have had a few views but no responses (am panicking about that one slightly!!)

Many thanks as always,

SnS
Some debts are fun when you are acquiring them, but none are fun when you set about retiring them!!! :(

A CCA is Consumer Credit Agreement. Most people request them from creditors to prove the enforceability (or otherwise) of the debt. If there is no CCA then the creditor is unable to take you to court for the debt, meaning that they cannot force you to pay. This only applies to credit taken before 2007. I'm sure someone will correct me if I'm mistaken but thats as I understand it.

Under the Consumer Credit Act 1974 you are, by law, entitled to an annual statement showing transactions on the account, so if you haven't had one lately send them a letter saying that you know you are entitled and could they please supply it.

Good luck, and try not to panic :D

    Hi SkintnScared,

Sorry you haven't had any replies to your earlier post but I expect a lot of people are at work so someone will be along later with advice for you.

A CCA request is a request for a copy of your original credit agreement with all the prescribed terms etc. This however does not apply to Utilities and mobile phone contracts and bank accounts. Also it is only for credit accounts opened pre 2007 as this is when the law changed regarding them.

From what you are saying you want to request, I think it is called a SAR request (which I think stands for Subject Access Request)whereby the company you are requesting it from has to send yuo copies of all the information/statements/defaults etc. they have on your account. There is a charge for this and from memory I think it is something like £10.

It might help you to understand what the various things are if you check out this thread https://forums.moneysavingexpert.com/discussion/2532927

Whilst the thread is now actually closed because some of the information is out of date, it still has a wealth of information that might help you.
This is the link for the SAR template http://forums.moneysavingexpert.com/showpost.html?p=33791917&postcount=23

Since you are only asking for a statement showing the outstanding balance and payments made I would just write and ask them for exactly that. They have an obligation to send you up-to-date statements and since you don't seem to need all the information from an SAR would suggest saving your £10 :)
