Unbelievable . . . . .

I got a call from the CSA today about my case.

The case worker I spoke to swore blind that I have to keep on paying until my daughter is 19, even if she is at university. I kept saying no and she kept saying yes.

In the end spoke to another one who she said had given her the advice and he got confused too.

And my daughter has decided to do a diploma and that really confused them as they said an HND was not recognised.

Confused - I am.

  • HND is a Higher National Diploma, as far as I am aware if your daughter is still in full time education you will still have to pay maintaince for her but I could be wrong

    Maintenance is payable whilst child benefit is being paid for the child which would be whilst they are in non-advanced education - it would not be payable if it is a Higher National Diploma but would be for a national diploma...it is the level of study that dictates

    If child benefit is being paid for the course that your Daughter is on, then liability via the CSA continues.

    If child benefit stops then so should CSA liability

    Child maintenance is payable all the time that Child Benefit is being paid and the child is:
    • aged under 16; or
    • under 19 and in full-time non-advanced education

    The definition of full time education is more than 12 hours a week of study on a course up to and including A level standard. Some examples of non-advanced education are:
    Non - Advanced Education
    • GCE / GCSE - A level / AS level / O level
    • SCE Higher Grade or equivalent
    • GNVQ / NVQ levels 1 2 & 3
    • BTEC National Diploma
    • SCOTVEC National Certificate
    • Scottish Certificate of 6th Year Studies
    • Foundation Arts Course
    • Secretarial Course with GCSE entry
    • NNEB
    • Hairdressing Courses

    This list is not exhaustive
    If the child is in advanced or higher education they would no longer qualify for child maintenance. Some examples of advanced and higher education are:
    Advanced Education and Higher Education
    • Degree
    • NVQ level 4 and above
    • DHE
    • HND
    • BTEC HNC / HND
    • SCOTVEC HNC / HND
    • Teacher Training

    When a child leaves full time education in the summer, Child Benefit generally continues until the first week of September.

    the CSA seem to have gone into overdrive this week. i received a call on monday asking me if i still wanted to pursue the father of my kids for support. my kids are now 27 and 30!
    the best bit is that i moved 300 miles away 6 years ago, and they managed to find me........how come they never managed to find my ex until now?

    Yes - it sounds like one of these. At higher level this is equivalent to 7 GCSE's grade A* to C. In that case, I assume it falls into the CS definition of further education and therefore means I will continue to pay CM.

    My question still stands why would someone who has 4 As at A-level do such a course and not choose the go straight to university. It is designed for people to move on thru further education or to build skills to get a job.

    BTW - I know that I have no choice and this is still a bit of a rant !!

    Maybe she needs the extra qualification for the course she wants to do at Uni.

    Or maybe she doesn't want to go to uni, and this course will be sufficient for her to start her career from afterwards.

    Actually, if she has 4 As at GCE and GCSE Maths and English at grade C or above, there is no way this course is going to benefit her university application. Advanced Diplomas are going to be abolished and I see the lower diplomas going the same way.

    It may be that she hoped to get work full time and do a proper gap year but cannot in the current economic climate. In which case JSA for an 18 year old or PT work would not bring much into the household, which makes study, benefits and CS an attractive option for her and mum.

    OP, personally, I would have a little talk with her and explain that you had hoped to save up this year to have some money to help her at university , as per your first post, and this is not now going to be possible because you have to pay CS to her mum, so cannot save anything.
