Mackenzie Hall

Hi I am new to this forum and hope that someone may be able to help. 2 weeks ago i recieved what i believe to be the standard Mackenzie Hall letter, in my maiden name asking me to call (did not say why). After calling them i was told i owe £314.32 from an old BHS store card taken out in 2003. My apparent debt was passed on to Mackenzie Hall from Activ capital. I am absolutely certain that I cleared any debt to Activ capital and looking back through bank statements my last payment made to them was in Nov 2007. Mackenzie Hall inform me that I defaulted in 2009, and Activ Capital passed the debt to them on August 28th 2010. When I asked for a copy of the original credit agreement I was told i would have to apply to activ capital for it myself? Today i recieved a letter in the post from Merit Force doorstep collection agents requesting that i contact Mackenzie Hall before the 23rd September or else!!! Any advice on what I should do would be greatly appreciated, the only proof I have of what I believe were payments made to settle the account are bank statements.

    If MH now have the debt, then they have to obtain the CCA uopn your request, Activ should have the details, it's not your job to chase it! Have you sent the CCA request letter? If not, a template is here...

    There are also templates for the follow-up request if you have already sent the first letter.

    To thwart the doorstep visits, see the thread above, there is also a template letter to stop these too. They have no legal rights to visit you at home and they have no powers to seize goods either, despite what they may imply. This is just a scare tactic, don't worry about it, I've seen a few of these off too!

    If you would rather see proof that the debt is still outstanding, you could ask for proof, again, the thread has a "prove-it" letter template. You could state that you require details of payments and the final balance, then you can compare it to your bank statements, it is not unknown for DCA's to add charges to the debt which you can get removed as they are probably unlawful anyway.
