Frederikkson, Bryan Carter et al + a Question:

A while back, I posted that I'd sought the help of CCCs. I'd recently had major heart surgery, so, as a builder, was finding working pretty difficult. On the advice of CCCS I wrote a template letter to all of my creditors explaining my situation and asking for reduced payments.

All except Nationwide were helpful to a degree. Nationwide just ignored my letters totally and leaned on me mercilessly. Eventually, I received letters - lots of letters - from the Carter Frederikkson Combo demanding that I repay my £1500 overdraft forthwith and any further delay would push the debt up beyond £2000.

I took the advice of a poster on this forum and wrote to Messrs Carter /Frederikkson and demanded to see copies of the credit agreement that Nationwide would surely have in their possession.

Nothing happened. So, I wrote once more, this time giving them 14 days to respond.

They responded about 3 weeks later to tell me the my "account" with them was on hold while they resolved the matter.

That was 3 months ago. To date, I've heard nothing more. Zilch.

So what will happen now I wonder?

Any advice anyone?

    Hi

    If this was an overdraft then it is not covered by the consumer credit act so whilst they may have an agreement it won't be one covered by the CCA.

    If they consider that your account is on hold then I would leave it as that at the moment. I assume you are now using a different bank for your current account?
    If/when they produce something or write back to say its not covered by the CCA then you should then be able to arrange to repay the overdraft in monthly installments that you can afford rather than all at once.
