Advice re 'Not fit for purpose'

Hi,

My sister in law recently purchased a new stroller for my niece who is nearly 2 years old, the stroller stated that it was suitable from age 6 months to 3 years so no problem there.

My SIL went out with my niece in the stroller the other day and the heavens opened. She got out the rain cover supplied with the pushchair and found a problem, my nieces feet were not covered by the rain cover and it also gapes at the side so not only were my poor nieces feet soaked, but her arms and legs also got wet as the water came in through the sides.

My SIL tried to return the pushchair within the 28 day return period to be told by the store 'well that's how it's meant to be' she argued with them that surely this could not be right only to be offered another rain cover, which would not have solved the problem. The store also stated that my niece 'must be big for her age' as this had not happened to anyone else!

She called the manufacturers of the stroller to no avail.

We are now out of the 28 day period, but are not really willing to let this slip. Is there any way that we could argue that this stroller is not fit for purpose as surely a rain cover is meant to protect the child from the rain rather than soak him or her. The rain cover was supplied with the stroller.

Sorry for the long post but this has really annoyed us and the shops attitude towards this has been appaling!!

    its a stroller as advertised, not a waterproof safehouse.

    Down it say fully water proof/shower proof ect?
  • I have to agree. She fits in and it rolls on wheels so its certainly fit for purpose. Weather proofness is another issue and you may or may not have rights depending on whether you tested it and what it was sold as.
    Back by no demand whatsoever.

    If it is hosing down we used to put the kids in wellies and waterproof coats, with scarves etc if in the winter.

    Is that not what everyone does?

    I have a very expensive wristwatch - it claims to be "water resistant" to 200M - not waterproof !

    The buggy will not claim to be "waterproof" either.

    My first thought was to wonder if she'd fitted the rain cover correctly, given that the way you've written the post implies that she had to hurriedly fit the cover as the rain appeared. Then you said she was offered another cover but that wouldn't have solved the problem. Why wouldn't it? Maybe there was a fault with the cover (too small?) and another one, properly fitted, would be fine. With one of my pushchairs the rain cover and footmuff that were supplied with it were actually the ones meant to go with another model, so both were too small. Changed covers and all fitted fine...can't understand why she didn't try that
