please please can some one help me im goin insane....

hello everyone im so glad ive found this thread... firstly i need to apologise in advance if im wafflin ive just had no sleep for over two weeks.... im about to go bankrupt have my date for the 26th october( this is when i can afford the fee) ive chose to go with an agent as hey help with forms and attend court with you as i have a very stressful job and mum very ill.... i have debts like everyone else and was payin them fine but i left a very violent marriage 4 years ago and signed house over to ex hubbie WHO didnt as ive just found out send theses forms on god knows why i didnt do it myself .....and house was repossesse so hence ive recieved a 55,000 debt letter as house was sold at a loss ive sort advice froom solicitor and bankruptcy only way out.....any how ive a few questions please before i ruin my new marriage and my health..... firstly i was told to open a cashminder account with co op ive now found out that i should not have done this until after my bankruptcy so im havin my wages now paid into my hubbies account is that rite????

also im so afraid that we are goin to suffer financially ive bein told they need to know what contribution my hubbie pays into the house we pay gas electric rent poll tax food water rates tv half and half so do i say we split down middle gosh im drivin myself mad....obviously i do not expect to come out of this not payin anything but my husband is worried they will take his wages too its only me goin bankrupt..... how is it all worked out??and what can a claim for?? as outgoings ? also one final question i know not to tell the creditors im goin bankrupt but when my debts arent paid 26th sept the calls are goin to start just wish i could afford do it now but cant sadly im sorry if this post is waffle but as you can see im soooo scared up to now all my debts were paid it is this 55,000 debt that as thrown me over the edge...... can anyone help me please :(:(:(

    Right - going to sound callous in the first line! If you are paying someone, then ask them the questions. As you are here asking yourself its proof that you DO NOT need to pay these people a penny as you can do everything youself. You have to do it all on your own anyway; accompaniment to court is not something I have ever heard of. How are you able to pay them anyway? Dump them. There is NOTHING they can do for you that you cannot do for yourself. I promise you. They cannot magic everything away, nor can they help with anything emotional and BR is 5% paperwork and 95% emotional!

    The cashminder is AOK. You have opened it with a prospect to going BR so use it. There is no problem with using the account before/after BR as the OR will not be interested in it as there is no overdraft on it. Many, many people do this. Unless you are in Brighton - the ORs there are the only ones who have an issue, oddly.


    You are kind of right with the household expenses. All the household stuff is more or less split down the middle (unless one of you is a terribly low earner). BUT list all the total household costs and NOT your share on the SOA forms then ensure your OHs contribution matches his half of the costs. Add to your SOA anything personal to you like clothes/insurances etc. The cannot make your OH pay a penny towards your BR. But the ORs do want to know that the costs are being split fairly and evenly; this is because some people have their OHs contribution as next to nothing so it appears they pay all the bills to reduce their outgoings and the prospect of an IPA.

    You dont need to tell your creditors anything you don't want to. You are not beholden to them and they dont own you. Change your phone numbers? It is going to be hassle from them in the short term (Its stuff like this a paying company cannot help you with!) and they will tail off once you have gone BR. But in the interim, ignore them - get call minder or caller display on your phone so you can see who is calling and only answer the calls from those you know. Or unplug it/change number etc.

PLEASE don't do this. You are paying for them to do nothing. You can fill in forms, you'll get great help all the way through from this forum, and they can't do anything at court except get the teas. They are not even allowed in the court room when you go in & see the judge. They can't speak to the Official Receiver, all this you need to do yourself. You can open up an account befoer BR. Just let OR know when you speak to them at court (usually on phone) and the will allow you to keep it open.

    You'll be fine. Firstly I presume you have taken advise & spoken to one of the charities - CAB, National Debt Line or CCCS? You will be asked by judge fi you have taken advise.

    What you could do re your debts, it write & tell them that you are seekign advise for a debt charity & that you are waiting for an appointment. Say that you will be in touch as soo as you have appt date. Then just sit tight until Oct.

    sky light thanks for your reply can i just clarify then i can do this my self? i contacted the iccs is it and they said they would help me fill the forms in over the phone but i gave the agent the details of my creditors letters with acc numbers on etc i have most of them but dont have the account number for the morgage just the name of the company .... the agent is chargin me 495.00 i dont want to go back and get my stuff sad i know will this be ok i havent signed anything..... also from what i understand your sayin regards the co op cash minder im under the impression tht the day of my bankruptcy that account will be frozen i cant afford forthis to happen because of my wages direct debits for household bills etc im sorry ive no experience in this at all thank you

    Technically, bank accounts are frozen on the day of BR. However, ORs have no interest in accounts that haven't any overdraft facilities so there are no debts or likelihood of getting debts on them; they have enough to do as it is! They are well aware that in the 21st century we need banking for simple day to day expenses.

    They still have to write to the banks to tell them of the BR, so just because the OR has no interest in an account doesn't mean the banks themselves cannot close the accounts. Halifax would close ASAP but the Co-Op is very BR friendly and is happy for you to have the account (as long as you stick to the terms).

    Now, on the flip side I cannot guarantee without hesitation that you will keep your account, its 95% likely that you can keep it but there is always that small possibility that you wont. Almost everyone here has kept their cashminder at BR.

    If you personally would feel happier to use your husbands account for the time being, there is nothing wrong with that either. Do whatever you feel comfortable with.


    If you do not want to go ahead with the agent then tell them. Phone and leave a message, email and follow it up in writing. Just be short and concise and tell them you do not want to go ahead with their services and to return your paperwork please. Ignore any phone calls.

    just ring the mortgage company and ask for the account number,if your names still on it they will give you it,you don`t have to tell them why or anything.The OR wasn`t interested in my co op account and the co op dont shut it down anyway.What I would do is get any excess cash out though.I filled my BR forms in online.There`s a help number you can call as many times as you like while you`re filling them in if you get stuck and they were really good just make sure you`ve got all your paperwork together.Just call the agency and cancel and tell them you want your paperwork back,as long as you`ve not signed you should be ok.You don`t need them.Any situation you run in to will have been covered on this board plenty of times so just do a search or post as many questions as you like.
    Main thing is to look after yourself and stay positive.The court hearing is nothing to worry about and a lot of the time you don`t even get put in front of the judge.So your man at the agency is getting £495 for filling a form in(on a good number there isn`t he).

    Definately do it yourself. I remember one member who recently went BR and was sat next to a heavily pregnant lady who had used one of these companies... they had sent her to the wrong court and not filled in the forms properly for her!!
    I think sorting out BR yourself will give you a small feeling of control over what has to happen, that's got to be a good point. Good luck :0)

    thanks so much ive just rang the agency and left a message that im not requiring thier services a friend is callin for the paper work just hope they dont get funny so here goes im doin it myself ..... YIKES if i cant find the morgage account num people have said the OR will hope thats right
  • On the upside now, if you have the £500 you were going to give them, you only need to get another £100 then you can go BR earlier - as soon as you've got money, together ring court for the earliest cancellation.
