posting this for a friend can anyone help .
he is currently going through a divorce with his wife , he left the marital home where she now lives with the 3 children and it was agreed that she would pay the mortgage which is in his sole name .
now she has stopped paying the mortgage , which will affect his credit rating . what are his rights can he ask her to leave the home , or what are his options ,
kind regards emmz29

If he were to ask her to leave the house, is he not evicting his children as well?
I may be wrong, but I do believe that a sale can be forced, but as he has not being paying the mortgage, I am not sure how that would stand.
I am sure someone with much more knowledge than I will be along shortly..
Best of luck0 -
Every relationship dispute with property and children involved has different dynamics.
There is no way he will get solid information from a forum. He needs a solicitor.
(Basically his credit rating is now damaged for 6 years - whether he is living in the property or not he is responsible for ensuring the whole mortgage payment is made).0 -
thankyou for your help
