Mortgage - Transfer of equity

My partner has a joint mortgage with her ex husband, she no longer lives in the huse and he has been living there alone for the last year until recently he decided to move out.

I am in the process of replacing his name on the mortgage to my own through a transfer of equity

However I have just found out he hasnot been paying the mortgage for the last few months .

I dont want my partner to take 100% of this debt on as she has not been there anf feel he should pay as he has been living in the house.

Do I have any options?

  • Your partner is already responsible (legally) for any arrears/the full debt as she would have joint and several liability on the mortgage with her ex. I would recommend taking legal advice asap.
