Mortgage/Legal Advice

A Long story, short...

My mother in law has left my Father in law for another man, Father in law is currently living in the family home which is on the market to sell.

There is a lack of interest in the house and it is not looking like it will sell soon. Mother in law is saying that unless it sells soon, she will stop paying her half of a joint mortgage.

Where does he stand if she stops paying the mortgage, can he take legal action?

  • They may have to lower the asking price. That will get interest.
    I dont think there is a lot your father can do any time soon. I would just lower the price to sell the house

    What a horrible situation for your poor father-in-law to be stuck in. I also think that the best course of action might be to lower the asking price...but saying that, does he have to sell the house? Could he afford to maintain payments on his own?

    Your mother in law and father in law are jointly liable for the mortgage. If she stops paying then he would need to make up the shortfall. Paying 'his half' would notbe sufficient for the lender. They do notcare how the payment is made up as long as it is paid.

    Ultimately if payments are not made the lender could apply for a possession order.

    If reducing the price is an option it may be something to consider.

    Your father in law may want to speak to a solicitor to see if there is any way of protecting his interests if she does not pay. Maybe he can pay the full amount and recover it from the sale proceeds.
