CSA old to new system phasing

Hi, I am after some advice as the CSA give nothing away.
My husband (NRP) pays £525 a month on old rules clerical case, on new rules it would be £360, we were desperate to get on new rules but told no chance. I happened across information that PWC had re-opened a previously closed case with another NRP so I asked if that would mean we could transfer onto the new system as the cases would be linked, to my joy we were told we would but payments would be phased over 4 years, going from £120 a week to £110 a week in year 1 and £100 a week in year 2 etc. We have only made one payment of £525 so it is not as if the PWC would have difficulty coming to terms with with new reduced amount? The CSA say that it is legislation that they can use and they are using it - is there anyway of disputing this????
Background - payments reduced to nil in 2004 - reassessed in 2010 to pay £525 a month and also need to pay £18000.00 in arrears back to 2006 (date when PWC first tried to contact CSA - they took 4 years to contact us), .
Any advice please?

    Also can anyone tell me do CSA backdate arrears to when the PWC asked for the reassessment (in my case Nov 2006) or when CSA contacted the NRP about the reassessment (in same case July 2010)??
  • i beleive they back date to when the pwc initially got in contact with them.
  • theres nowt u can do about phasing, it can last up to 5 years, worst piece of legislation ever
  • My OH made a claim from his ex wife and the payment's started from the day she was contacted not the day he contacted them but it may be different for men than women (joke!!!) There was only months difference though.

    Have CSA agreed that July this year was the first time they tried to make contact with you as it seems mighty unfair that they would wait 4 years then back date it. May I ask why you didn't pay any maintenance until now as it also seems unfair that your OH's children did without when it appears you had the income to help?

    It's when the PWC asks for a reassessment. As unfair as it seems, your husband should really have notified them of change in circumstances so if the CSA did something like that, (not notifying the NRP) then he wouldn't have racked up arrears.

    Nothing can be done about the phasing in either, unfortunately.

    Morally he should have notified them but legally he is not obliged to notify them of any wage increase. The PWC had remarried, had a third child (to 3rd Dad) and we were niavely under the impression that the new husband was providing. The fact that she deliberately stopped taking the pill 14 years ago and made the decision to have a baby with my husband without his consent was not morally right either though.
    The thing that angers me is that the CSA knew we wanted to get on the new system, our MP even asked them if it was possible and we were told that it was not possible.........CSA lies again. It was possible as we are now on the new system after some extensive internet research but we should have been on the new system from the start. The CSA are playing with peoples lives and picking and choosing what to do with each case and what information to give away. They are deceitful, underhand, malicious and I really could not do that job for any amount of money.

    Believe me, I have very strong feelings about the CSA myself too.

    But they do ask for change of circumstances to be given. They may not penalise an NRP if the COC is later than it actually happened ... but the very fact that they can do what they have done to your partner is another huge reason to keep them informed of COC's.
