Council tax bill after 10 years

This week i recieved a liability order related to council tax from 2000/2010- this is the first ive heard of it. the woman at the end of the phone could not locate any correspondance related to it on her system- what should i do?
Can they still claim it back eben after all this time if it is legitimate which i seriously doubt.
Thanks
in anticipation

I would send them a letter asking them to prove that this is your debt for a start. Even if it then since it is over 6 years old it should technically be unenforceable but councils have a nasty habit of getting ccjs on their debts so if that is the case the 6 year rule may not apply.

The council wont use CCJ's , they use Liability Orders which are different (applied for through the magistrates court).

Providing a Liability Order is obtained within 6 years of the amount becoming due then the Liability Order is legal and remains in force until the balance is discharged.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Agreed, the council can seek the last 6 years of payments via a liability order, and they can seek repayment of debts prior to that so long as they already have a liability order for it.

If this is the first you have heard they can only claim from 2004-2010 at the most. And even then you can ask for them to prove you owe this money.

Do you have proof from bank statements you have been making the payments required?

There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies
