If you are under the chosh from the enforcement team this may affect you!
I have spoken to a guy at work who's daughter is in the 'Higher Levels' of the enforcement office in Leeds!
He informs me that they are undergoing a radical shake up and a number of the people that work there are to be lost! This brings problems with it.
1. If you are in arrears and have been threatened with Court action it is unlikely to start before the announcements due in October, this will also affect those waiting for the action to be taken as well!
2. It is believed that the recovery targets are to be increased, and as a result, Debt Collection agencies are to be used, so the excesses that are current will seem to be as nothing to what is to come!
The advice that she has given is that in the event that anyone gets a notification of an application for a LO, get in first and make an application for a Warrant of Suspension and/ or variation Order. This will put the whole thing back in the hands of the Court, who will decide how much is to be paid. Once an Order/Warrant has been issued there is no further enforcement allowed, as the Court will have to give permission and they will use the powers granted them to protect people!
The cost of the application is at this time £35.00 and you will need Form N245, but if you ask for a Warrant application and explain they will give you the form at your local Court.
Hope this will help people.

Thanks for this. Does this also mean that for those already subject to a liability order or a DEO they could potentially apply to the court for a suspension/variation warrant.. for example changing the 40% deduction on DEO where you can demonstrate that your day to day living costs etc.. are not sufficient and it will cause hardship.0

Hi runforcover, my understanding such as it is, is that wonce you have the LO in place it is too late to apply, you will just have to fight it out as best you can, and remember it has been stated by Judges that the law is written in favor of the CSA.
Again I believe that it only covers the payment of arrears not a DEO. A DEO is as I understand it outside of the power of the Courts, unless it is Defective, then you have an in as it where.
Take heart you can win but it is a very big fight and it gets bloody.
