BRO and applying to be Company Director

Options
I need to form a limited company and so need to apply to the Court to be a company director. The reason I got a BRO was nothing to do with fraud or anything else, nothing serious, all very petty but the weight of the whole thing dragged me down I gave up and didn'nt fight. The BRO is for 3 years.
If I apply to the court to be a co. director will the Insolvency Service try to block the application? It's really none of their business in all honesty as they deal with the past and not the future.
I'm not looking to get credit or run up debts.
What reasons can the court say no? and will the IS try and block me?

Thanks :T

Yes they probably will try to block you. The IS is not just about the past, part of their public duty is to stop people who may pose a risk to the public from doing so, which is why they apply for BRO's in the first place
Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.
  • I've never posed a risk,my case will be to grow a business in profit and employ people.what will they say to block me? is it worth the effort?

One fo the restrictions of Bankruptcy isnot being a company director, this would ahve been clearly explained when you went Bankrupt.....Why do you need to form a limited company? Not all business are limited....
  • Apply for what you want, but research it, justify it, if the OR blocks it then it may cost little or nothing to challenge it at county court (depending on your income at the time). you dont have to answer these questions on here but ask yourself - Did you challenge the initial BRO or did they put it through the courts unchallenged? Are there other options - a friend / relative who can create a company and you to be an employee /company secretary of it (Co Secretary is allowed)? Can you go self employed?

You can still challenge a BRO even though it has gone through (at least that's what my OR told me on the phone), but is alot of grief. The OR wanted to give me 4-5 years, i challenged it through the court and eventually relunctantly accepted 2 year BRU - which is the minimum they can give.
  • Hi Folks, Just a quick query which I'm sure was explained to me when I went BR back in 2004.

Does a personal Bankrupcty order stop me from being a partner in a company?

    Thanks
