Car repossessed previous owners debt

I bought a car almost a year ago and it was repossessed a week ago due to an outstanding debt from previous owner. I paid an agreeded amount of money to claim the car back and planned on chasing the previous owner through Small Claims. It has since come to light that the previous owner took out the loan with MobileMoney before he sold the car to me, then after selling the car he took out a reloan with the same company after I had taken ownership of the car. My question is - should MobileMoney have checked that he still owned the car before reloaning?

  • No t really no, you should have checked the car's HPI history before you bought the car, as even if he hadn't have took further borrowing, the debt still existed secured on the car.

  • How did they "repossess" it? Was there any court order? MobileMoney are a "log book loan" company and I have always wondered how they can enforce the loans because any person can simply apply for a V5, keeping that document isn't any security on it's own.

    I used to work in the same office complex as one of their branches and occasionally I would see cars left outside, sometimes with a wheel clamp attached and I assumed they were cars that people had handed over, or they had managed to "repossess".

    Other posters on here have advised that log book style companies do not make an entry on the HPI register and are not picked up by an checks you can do.

  • I am all too aware now I should of done an HPI. MobileMoney sent warnings to previous owners house of impending repo but took car from my home with no notice no knock on door nothing! So reported it stolen. They wanted the full loan £1800 paid back managed to barter them down by £700. Small amount of cash in vechicle missing! Have talked to the previous owner whos very apologetic he knows I will be taking him to court but because he took out a further loan to pay back the orignal loan after I had got my own log book on the car I'm wondering whether It was legal for them to repossess the car, because car is a work tool I have lost a weeks pay as well!

    Might be worth a call to consumer direct to be honest. Sounds as if you're doing everything as you should, but it's unlikely you'll have any comeback on the lender, more than the lender should be going after the debtor!
