Help needed again please!!! re court letters

Hi folks,

Coud do with peoples invaluable advise again please.
I have previousley written on here with regards to some major debts my husband has. Just to recap: charging order (restriction) on joint mortgage , debt in husbands name for approx 24k. House is valued at a guess approx 80/90k in todays market. SA tax debt at approx 2.5k paying back monthly. lastly 15k unsecured which we have just recieved court letters for. Forgot to say owe just under 50k on mortgage.

My husband has recieved the standard letters for Northampton county court with all the forms to fill in i.e admission, income and so forth.

I could really do with some advise firstly how to fill the form in correctly.
We cant pay the whole amount in full and i need to know the process involved.

Any help would be appreciated. Dont want to get it wrong.x

Just to add all these debts are in husbands name only not mine.

    Hi Laney,

First of all, don't worry the courts will not expect you to be able to pay the whole amount back straight away. The idea of the income and expenditure form is so they can see what you can afford to pay a month, and they actually tend to be a lot more reasonable then the dcas. (I had one take me to court as they weren't happy with the amount I was paying them and the court said I was paying too much and cut it down!) If you need help filling in the forms could try your local cab and they should be able to sit down and go through it with you.
  • thanks for your advice. Will have to try an get in contact with CAB or CCCS to help me with the forms.
