Help needed with Debt Collecting Agency

I am having problems with a company called DRS, i have a payday loan with them and hit hard times when my husbands hours where cut at work. I wrote to them to offer them £5.00 a week until i could clear the balance, they keep writing to me asking to see bank statements and wage slips etc. I have paid them every week without fail since 30th July, but they are still keep sending letters asking me for the information.

Also i have a loan with Early Payday Loans, and have offered the same amount weekly, but they keep sending me texts, calling me at work stating they want to discuss this with me, but i would rather not call in case they try to talk me into something i cannot afford. Please could anyone give me advice.

Thanks

Really just keep paying what you can afford and no more.

Don't be pressurised into paying if you really can't afford it.

You are not obliged to send wages slips, bank statements or any other private information.

It's entirely up to you, but I certainly wouldn't send private documents of that nature to a debt collector.

A financial statement/SOA is perhaps fair enough, but no more.

  • Hi Happymonkey40

I most definately would not send something as personal as a bank statement nor a payslip. This is far too much information for a company whose industry regularly conduct themselves in an unsavoury fashion, nor do they have a legal right to it.

A SOA/income/expenditure sheet is more than reasonable and some would say even that is too much.

Have they frozen interest or is this still being applied to your account?

You're right when you say you shouldn't speak to these people on the phone. Keep everything in writing, they won't like that as there will be lots of things they will be prepared to say on the phone that they wouldn't commit to in writing nor can you be pressurised into paying more than you can afford!

Stick to your guns, you are doing really well, you just need to be a little persistent.

They are breaking OFT guidelines by harassing you at work - might be worth a complaint to the authorities.

Send the template letter I posted above - you can stop them contacting you by phone completely.. it's post #4 on that thread.

Send NOTHING personal to a DCA - they can't be trusted not to misuse such information, and in any case, they have no right to see it.

I agree things should go via a SOA, problem been is their are so many dishonest people who make them up. I would go the cab and they will see to it for you.
