Aktiv Capital Default Notice

I had a letter from Aktiv Capital. I sent the prove it letter to which I got a reply saying that the account is on hold.
In the meantime Aktiv Capital have added a Default Notice onto my credit file. The old default from Egg was removed a couple of months ago. Can they add the Default if the account is on hold?

Thanks in advance

If Aktiv have had the debt transferred to them, then they can legitimately have the Egg default removed and replaced with one in their name.

They are not allowed to change the date of the default though. It must be the same as the original.

What "prove it letter" did you send BTW?

  • I think it was the one that requests for a signed copy of the cca.

They haven't changed the date only who the default is against.

Well, the Information Commissioner says it is OK to do that when a debt is sold on to another company.

For now I wouldn't worry about it. Just wait and see what (if anything) Aktiv come back with.
