i used the template letter to try and have a default removed. i have recieved a reply back from vodafone concerning having the default removed from my credit file. it says the following. '' i would like to advise that Vodafone Limited airtime agreement is not a regulated product for the purposes of the consumer credit act 1974. Vodafone Limited is therefore not obliged to send you the documents requested. Furthermore, Vodafone Limited will not provide the documents that you are demanding nor are we bound by the timeframes that you have set out'' They then list invoice dates and the dates when they were paid. They then say '' Collections letters were sent out on 01.11.05 and 19.01.05 advising the consequences of non-payment. Is there anything more i can do to follow this up as i dont wanna have to wait yet another 2 years for my file to be clear again. cheers

It is true that they are not covered by the CCA - however they still have to provide proof of a debt.
If they havent got proof, then they shouldnt have defaulted you and you could actually sue them.
I would report them to all the authorities, thats the only way you can get through to idiots like this....0 -
Mobiles are service agreements not credit agreements. You cannot use a CCA request nor mention it in a letter as they will shoot you down.
You should send vodafone a SAR, costs £10. - http://forums.moneysavingexpert.com/showpost.html?p=33791933&postcount=24
They must provide you a copy of all letters they sent you, and this will include a default notice as to apply defaults to a credit file a procedure must still be followed. If they don't send you a default in the SAR then they never produced one. And the default is unlawful so should be removed, if they refuse take it to OFT and if they agree then, finally to the ICO to remove it.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
