CSA [old rules] quiery

Hi all

I was wondering if anybody has any insite into the CSA "old rules" system?

I've been on the old rules system since I was first assessed [2000 ish] and I currently pay £280 a month, an amount I've been paying for a at least 5 years now. In that time my wage as risen by a few thousand £'s per annum.

My son [the only child involved] will be 16 years of age in January and my questions are...

1. should I request a re-assessment? I should be paying zero carers allowance at 16 years of age? [I think I'm paying 50% of it at the moment, maybe 100%]
2. I have zero contact with my son/ex-wife - what happens when he leaves school? how will I know if he continues on at school/college etc?
3. Is there any indpendant organisations/companies that can calculate it out for you?

As we all know, contacting the CSA is soooo difficult - and dealing with the hassle is putting me off making that phone call, but it's nagging me that I'm not paying [over-paying] the correct amount

  • You are correct, that if your son is 16 it will take out the carer's allowance element, which would reduce the Maintenance Needed. However, whether you get an actual reduction in your payments rests on the rest of the calculation. Your income has risen, meaning more to include in the calculations, and you don't say whether you pay the full amount of maintenance, or whether your protected income reduced it at all. If you are paying a reduced amount, then you may find that your increased wages means an increase to the full amount - plus you could end up paying an additional element.

    PM me your details and I will do my best on what you give me. HOusing costs are needed - if rent, full amount, if mortgage, your amount outstanding, monthly payments, interest rate. Do you have a partner? If so, details of her income are required,, broken down into whether it includes any benefits. Do you have children living with you? if so, are they yours, or step children? How old are they? Your net income less any tax, national insurance and HALF of any pension conts you make, any other income you may have.

    If you have no contact with son or PWC, then it is difficult to establish at what point the child leaves qualifying full-time education.

    But, you can contact CSA and request that they perform a benefit check on the PWC, if she is not in receipt of child benefit then CSA will contact her, and inform her they are closing the case - this is what they did in our case! Except when the CSA rang our PWC to inform her case was closing as she had not received child benefit or child tax credits for over 4 months, she told CSA she 'hadn't realised', and that the child in question was still in education, and she would chase up with child benefit office, and CTC helpline, so CSA reinstated the CSA liability on the sayso of the PWC - we doubt she would not have 'noticed' her benefits had not been paid for 4 months!!

    But worst scenario, if a PWC encourages child to enrol on further education course, she can then claim CTC, child benefit and CSA, not castin shadow on PWC (I'm on myself), just my hubs ex (PWC) is not an honest woman!! I could tell many many tales but after 17 yrs of being with my husband I have grown weary of our PWC, she's not worth the effort.
