Trying to reclaim fees and getting nowhere!

Hi,

Any thoughts or ideas from anyone would be appreciated, will give a brief rundown of the situation.

I finished a 5 year agreement with DCM Apex (seeing that name will probably make some people cringe) at the beginning of June. Did some negotiation and got a couple more debts paid off by them after that date (one of which already had a CCJ issued against me during the time DCM were managing the account and the company was in the process of further legal action having applied for an agreed notice on my property).

The agreement stated that if all debts were not paid off within that 60 month period I would entitled to a full refund of all initial and ongoing fees. DCM have also confirmed this over the phone, several times and have told me what the fees refund amount is.

After some arguement and a complaint letter (to which their response was a joke) I sent in written confirmation that I wanted all the fees, refunded to me, they received that letter on 16th August along with a SAR.

I have heard nothing since then! Whenever I phone, only the Office Manager will speak to me, if I ask to speak to anyone else all they say is I have to deal with her (office manager). I did manage to speak to her last week (she doesn't work full weeks and has been on holiday) and she told me another employee is dealing with it and basically fobbed me off (pretty much the same as they have every single time I have called about anything).

Basically, I am after thoughts and opinions on where to go from here? The 40 days (from the date of the letter?) for the SAR are up next Monday (20th), but my opinion at the moment is that 3 weeks if an unacceptable length of time to action the rees refund, bearing in mind that it is now over 3 months from the end of the agreement!

I have been intouch with the CAB and had an appointment with them regarding the many other issues I have on how DCM have ... errrr .... 'managed' my accounts over the last 5 years. The CAB have sent a copy of my agreement and synopsis of my situation to a solicitor to have it reviewed.

I am going to be contacting CAB again about the fees refund aswell, but always interested in the thoughts and opinions of the people here.
