Apex Full and Final offer wording

After playing hardball I managed to get a full and final offer of £300 accepted on a debt of over £700 with Apex.

In their short letter in which they accept my offer they say
'We can confirm that we will accept £300 in full and final settlement. This proposal is only valid for 7 days from the date of this letter'
To me this seems excellent. BUT I want to be 100% sure this will be the end of the debt. Do you think I should ask them to send another letter more specificaly stating they will not sell the debt on to a 3rd party once they take my settlement offer? Or is what they have told me enough for me to know they wont pass it on?

Thanks for reading! J

  • We advise you get the wording as mentioned in the NDL template
I want to offer this as an ex-gratia payment in full and final settlement of the account. This offer is made on the clear understanding that, if accepted, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released from any liability.

I also request that, if accepted, you will make an entry on a credit reference agency file relating to the above account as having been paid and the account closed.

Bold part is the important bit

I wouldnt trust any DCA as far as i could throw them - once you pay up, they will forever see you as a cash cow and an easy target.
  • Thanks for both of your replies. I will get on to apex asking for assurance.

  • Full and final is good enough. You have it in writing, so it doesn't get any better than this.
