council tax and br

  • I have emailed the ors office about this and am waiting for a reply.

I just want to make sure that the council is correct this time as I dont want to end up doing the wrong thing. I am quite prepard to pay the rest of the years council tax if this is correct but dont want to get in to trouble by paying it if it wrong.

As I said, I thought in the first place that only the arrears was included and told the council this. It was them that insisted that the whole year was to be written off only to change their minds a few days later! As they dont seem to knowwhat they are doing I just want to get it right

I didnt make the first payment of the payment plan untill a month after the reminder which was a few days after br.
I have explained all this to the OR and await the reply.
Thanks for your replys and advice and I will let you know what the outcome is when I get a reply.
  • Hi,

I was in the same boat. I was paying by an arrangement, but was still all included in the BR. The council staff usually have no idea about the IS tech manual - (sorry CIS) mine didn't. They tried to say that their book guzumped anything else written....

I've pm'd you my letter. Just edit where necessary.

  • Thanks Miss Spookey. Ive got your letter. Just waiting to see what or says and then will probably send letter to councl. Did it effect you having a ipa?
  • Hi,

    Just sent other bits.

No it didn't, what will happen is that you will still have to show that payment on your SOA as come 1st April 2011, you will have to start paying again. As far as the OR is concerned you will have to pay it. I wouldn't hold up much hope with your OR as they usually don't get involved in things like rent arrears & council tax. The rulings are there but for some reason they choose to allow the Councils discretion - No disrespect for the OR's but it's probably one less fight they can do without, seeing as it is a bill that will reoccur in a few months time. • Thats more or less what the ors office told me in the first place, so I will send them the letter and see what happens from there Thanksvery much
  • Ive sent the letter by recorded delivery. will now wait and see what happens. I have not had a reply from OR as yet.
If I have to pay it I will but just want to be sure they have got it right as the council dont seem to know what they are doing.

I have heard nothing more about this, have not had a reply from council or the or.
I will wait and see if they take this months council tax, i would have thought they could at least reply!
  • Just a update, the council says as I was only sent 1 reminder that I have to pay he rest of the years council tax. Im not sure if thats right or not as the council dont seem to know what they are doing!
As I said before, I was two months behind with the council tax and and had a reminder which said if I didnt pay the full amount within 7 days then the whole amount would be due.
I rang them and set up a payment plan but this didnt start til about a month after by which timeI was br.
I was then sent a bill showing nil to pay for the year, then sent another bill showing the rest of the years installments.
Im not sure now wheather to leave it and pay or write to them again.

You need to make sure they don't think you are liable as you may be faced with a big bill and a fight. Have you been in touch with your local CAB? Can thet act on your behalf?

  • No Ive not been in touch with Cab or anyone yet. I have paid the first payment as I dont want to get behind if they are right.
If I have to pay thats fair enough but as I have no faith in the council I would like to make sure what they are saying is right.
They gave no explanation as to why they sent me a bill for nil outstanding in the first place.
