CCJ- Judgement says I have to pay in full and I can't!

    I do agree with you. After a number of phone calls with Nationwide and KPR - who ask me could I not borrow the money from family friends or neighbours, to clear the full amount, which left me speechless It should not surprise me that I have to go to court.
    Has anyone been to court in a situation like this?

    Nationwide have just done this to me too :mad: ,for an old overdraft which now amounts to £2905.27, despite fact that I am on and paying a DMP with CCCS.

    Letter & accompanying documents going by 1st Class Recorded Post on Monday..

    Letter & accompanying documents going by 1st Class Recorded Post on Monday..

    Check with the court first before you do.

    Depending on how the judgement has been made, sometimes you need to fill in forms and pay a fee still.

    The court will tell which applies to you.

    You can appeal the decision and request a hearing in YOUR own town, the case should have been heard here anyway.
    Then you can go along with all your paper work and sit down and the order will be set aside and replaced with a new order based upon what you can afford.
    When you say received an order, I take it you did not receive the summons, you just got the order ?
    that is grounds for the appeal.
    Appeal it and TURN up putting your head in the sand gets your harss kicked.

    No. They received the initial claim forms and responded within the timescale that they should.

    Hi all,

    Thank you for the replies.

    I received the initial Order, which I completed together with a copy of CCCS budget and list of all creditors. I will ring the Court on Monday but will have a letter prepared just in case.

    I hope I don't have to fill in forms but will do if I must. A fee... for God's sake, I am already trying to pay a DMP yet I have to pay to prove I can't pay any more than the DMP amount....which is a contradiction in terms in itself !!!

  • T/phoned CCCS today who advised me request a Redetermination and because I'm doing it within 14 days of original judgement, I wont have to pay a fee.

    Thanks to all who have provided advice and support.
