CCJ Court Warrant
AJC25
Hi all, first post here so please be gentle. I'm worried sick by a letter I have received this morning from Aplins Solicitors. I posted on another thread and some kind soul has pointed me in the direction of this thread.
I defaulted on car finance about 5 years ago, was issued a CCJ and was paying £20 per month on a balance of 4,000.
3 months ago I was made redundant and I am still on JSA, whilst searching for a new job. I contacted Hillesden Securities to explain but they weren't very helpful and basically said you still have to pay. I tried but I just don't have the money.
The letter I received this morning was:
We are about to issue a warrant of execution against you. This will incur an additional court fee and costs which will be added to the amount you already owe.
Unless you pay the amount of the warrant, the court bailiff will call at your address with with a view to taking an inventory and levying on goods belonging to you.
If you still do not make payment the bailiff will remove goods of sufficient value to clear the warrant.
The goods will then be sold at auction.....at auction prices.
I live at home with my mum and don't have anything of value apart from a computer. There's just me and my mum in a rented house as my dad died young and most of my JSA goes on help towards the rent and bills as she wouldn't be able to manage on her own.
What can i do, please help somebody.

Tell your parents to inform the bailiff that you do not live there and nothing in or on the property belongs to you!
That's what my mate did, they could not inforce the warrant and to date he has not repayed a thing.0 -
As your circumstances have changed, you can apply to the court to ask to pay a lower amount due to your change in circumstances. However, the national debtline factsheet suggests that you try and set up a repayment plan with lower payments.
Here is the fact sheet from NDL http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=08_reducing_payments_or_suspending_a_bailiffs_warrant_on_a_county_court_judgment
I would phone national debtline and ask their advice as to how much you should offer to pay (basically it should be what you can afford, taking into account your circumstances), and whether you should apply to the court anyway to reduce your payments.
I would reply to the solicitors letter explaining your situation. Ask them to suspend action until they can tell you if reduced a reduce payment plan is acceptable. (send recorded delivery).0 -
lying to a court baliff aint wise, this could make it worse as they can check where your benefits are paid. Contact the CABDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
