great first credit threatening to take me to court ...

And this is over a debt that has already been paid :mad:

I want to just ignore the letters they're sending, but it's getting a bit worrying now.

What do I do? Help me please someone.

    Ok firstly all dca will threaten to take you to court, it's quite rare they actually do it so try not to panic.
    You say the debt has been paid - how long ago? was it to this dca or the orginal company? do you have any proof of it (receipt, letter, bank statement)?
  • I haven't got any proof :(

    all I remember is that my fella paid it for me as I was out of work at the time, and his bank statements only go as far back as January 2010 online ... we've since moved to Wales, so cannot locate all of the bank statements

    the debt was paid about 3 years ago now and I'm sure it was to a different dca, just wish I could remember how long ago the original debt was made as so much has happened since then
  • You can ask your bank for statements going back 6 years should cost no more than £10, does take a while though.
  • I think it might end up coming to getting in touch with the bank ... it's over 5 years ago since the original debt was made, but can't remember to the exact date, still don't get why I'm being chased for a debt that's already been paid :(
  • You should ask them to send you proof that you still owe this debt and not just a letter telling you that you do.

    I would have a look at the template for the 'prove it' letter and customise it slightly to say that you have already paid off this debt and to stop harrassing you. If they still keep writing to you then will probably need to get bank statements to show the payment going out to them - if you know the date for it then can ring the bank up and request statements for that month, if it's just one then sometimes they are nice and don't charge you for it :) If you're not sure then will need to send a SAR requesting all statements which will cost £10 and can take up to 40 days.
  • with these guys do I need to avoid signing it? I've heard about other people having their signatures forged by this company, so am a bit nervous about sending anything ...
  • It is up to the DCA to prove that you owe the debt. Print your name if you are worried.

    Wait for them to give you more information so that you can check that the debt is yours.
