CCA request or statute barred?

Hi,

I've got a letter from a debt collector asking for payment of a large debt which I do not recall having. They called me recently regarding this and asked me to pay or they will start legal proceedings to force me to sell my house to pay the debt. I told them only that I knew nothing of the debt and they said they'd go back to the lender and prove it was mine. They said the last time a payment was made to the debt was in the year 2000.

As a 10 year old debt should I be going through the CCA request route or the Statute Barred option? Entries have appeared on my credit file recently regarding a default on this debt and I need to get this sorted asap.

Any help is appreciated.

  • 'Prove it' letter first. Make them come up with the evidence in writing which you need for the next steps. And if the last payment was 2000, it is statute barred and any default should have fallen off your record years ago. They are out of time to apply defaults to your record.

    As I read it, it sounded like the information was gained in a telephone discussion. This counts for very little, which is why I suggest covering the ground again in writing. Of course if the DCA has provided in writing info equivalent to a response to a 'prove it', then no need to cover it again.

  • Well I sent the Statute Barred letter nearly a month ago and have not received written confirmation that no further contact will be made, in fact I've heard nothing.

    There have, however, been 2 further searches on my credit file since the letter was sent. Is this allowed? Surely them making searches is not going to do my credit history any good?
