CSL help - again!

Hi all

I posted recently regarding cheques which hadn't been cashed by CSL. I have an arrangement to pay them £6.39 per month and have always maintained this payment. Following helpful advice from Hannah_10 I posted a cheque for £12.78 (after cancelling 2 previous cheques which hadn't been cashed) and copied this cheque and covering letter for my records. I then posted the letter recorded delivery on Sat 4.9.10.

I've come in from work today to a further letter from CSL dated Mon 6.9.10 saying that:

1. I have ignored repeated applications for settlement.
2. I have had the benefit of goods/services supplied for which I have not paid.

"Unless we hear from you within 7 days with a payment and repayment proposal we may without further notice:

a. Instruct 1 of our local collectors to call upon you for payment.
b. Proceed with legal action for recovery through the county court."

The letter then asks me to promise to pay £....... per week until account is paid in full.

I have checked Royal Mail on line and the letter was delivered on Monday so I'm wondering if my letter and CSL's letter have crossed in the post or whether they've sent this after receipt of my letter. My cheque has not been cashed. I'm worried about this as this payment was agreed after going to Court a few years ago and I don't know what the problem is now.

Any advice would be gratefully received.

    I would have said that their letter has crossed with your letter. You have paid and you know it was delivered, just watch for your cheque being cashed.

    Assume crossed paths for now and don't panic. Next month, again send the same, signed for as ever. As you have proof you sent it and they recieved it thier letter only makes them look like idiots (all the more reason they wont take you to court then).
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared
    [STRIKE]23.16%[/STRIKE] 22.49% of my debt. :(

    Thanks for the advice. I get paid next week so will be going the post office again on Saturday morning and sending this month's cheque with a covering letter which I'll again take photocopies of and I'll post recorded again.

    You could always try asking for their bank details so that you can set up a standing order (NOT direct debit!!) then you will be sure that the payments have reached them. They are probably not cashing your cheques so that they can hit you with more charges and fees etc, you know what they DCA's are like :mad:

    I'm a cynical little critter me...

    I say, let 'em pile on the charges, because when you complain to the ombudsman (and win) because you can prove they DID get the cheque then you can also ask the ombudsman to make the DCA pay you compensation...
