moan and advice needed

Hi all

Well there i was thinking i was making progress. DMP set up with Pay Plan, first payment made. Spending diary being kept and spend monitored - although admittedly this is work in progress and for the first month in years i was actually going to live on the money i had without getting more debt!!! and then......

about 2 months ago I changed the bank account that my Direct Debit for my MBNA credit card come out of. MBNA explained that for the July payment the DD would not be set up in time so i needed to make a manual payment. which i did. then they tried to take the DD anyway and it was refused as there wasnt enough money in account because the money had already been used on the manual payment. I spoke to MBNA and they refunded the default charge as they could see i had made a manual payment.

Now my bank (alliance and leicester) have just added a default charge of £25 to my account for the unpaid DD (some 6 weeks after the payment). They are saying they sent a letter advising this would happen but i cant recall seeing it otherwise i would have challenged it then. I have just spoken to the bank and they have said that i need to get the £25 refunded by MBNA as it was their error. To make matters worse the £25 has taken me over my overdraft limit so I am going to incur more charges until i can find the money to get me within my limit again. Once again i have to try and get this money back from MBNA as it their error according to the bank. so i am incurring more and more charges until i can find the money to get under my overdraft limit and the advice is i have to claim this back from MBNA.

Does anyone have any ideas on how to claim monies back from MBNA?

Does the fact that i am now on DMP make a difference?

It is just so frustrating that i thought i was getting somewhere and through no fault of my own i am in trouble again!!!!

    thanks. its a nightmae but i have found the money to pay into the account to stop more charges at least - although it will put me very down on money for next month.
