I have a few days off now so first thing tomorrow I am phoning the cccs to see what they say. Can't do any harm and there might be things I haven't considered . Will also talk in detail about bankruptcy as this seems like it could be the best option.

Sorry my fault, he lives 4 days with me and 3 with his mom. I let her have the majority of the benefits so I don't have to worry about clothing my kid, at least this way he always looks smart.
In which case you need to claim child benefit and any other benefit for him, not let her do this. Then ask her for maintenance, although that will be reduced because he spends 3 days with her.
But you housing cost is the major issue:
1. As it is in negative equity, the OR would not claim any (non-existant) equity if you went BR.
2. The OR would however probably NOT allow you to keep the house if your rental costs would be lower than the mortgage payment.
3. The OR would ahve issues with your arrangment with your child - letting your ex get money that shouold come to you.

Is your mortgage interest only?
