Complaint against OR interviewer?

Do these people answer to anybody? can I make a complaint or something?

I've just had the most rude, judgemental, obnoxious person I think I've ever had the displeasure of speaking to. At one point I had to take the phone away from my ear because I was about to say something that would have got me into a lot of trouble.

I'm still quite upset and angry, maybe I'll calm down and forget about it, but at the minute I want him sacked.

    not wishing to start an argument, but what does the creditors feelings have to do with anything. This person is talking about the OR and the OR does not work for the creditors and should be impartial. If the OR was rude, judgemental, etc, then I would go ahead and put in a formal complaint. They are not there to judge or to make life difficult. They are there to get the facts and process your BR.

  • still no matter...the receiver is bound by rules & has to remain impartial at all times...they SHOULD not be judgemental in any way whatsoever

    put your complaint in writing address to the receiver who deals with your office & if possible the name of the examiner who you complain against

  • Do you seriously think that anyone who has gone or is going bankrupt would see it as an inconvenience for them? If you are here to cause a row then go and do it elsewhere. Why are you actually posting on here if youre only here to cause a problem. Im sorry but I dont have time for this type of post.

    First off, it wasn't the actual OR, it was whoever does the interview for him.

    Before we'd started I apologised in advance that during a lot of the period involved with my debt I was suffering mental health problems and on medication, so I may not have specific dates or bits of paper he needed, and that said health issues were why I was in this mess in the first place.

    I posted everything I had that was on the list of things they needed before the interview last week so I had no point of reference regarding dates and amounts of loans or credit cards as they had all the paperwork, he said he didn't have any paperwork and that it must still be in the post, and yet he was guffawing and tutting every time I said "I don't know, it was in the paperwork I sent you".

    When I couldn't be specific about what the money was spent on (years ago) he just kept saying, "that's not good enough, don't you know where the money went? if I'd spent XX amount I'd know where it was" I kept apologising and stating the reasons for my lack of knowledge but it didn't seem to make any difference.

    When asked for a "reason" I quoted some information regarding this from my psychiatrist about how mental health can lead to spur of the moment purchases and rash behaviour, especially when on medication, apparently the opinion of a qualified Psych isn't good enough for him and he said "I can't put that down, I can't quote what someone else thinks about YOUR spending"

    Again I apologised for not being able to be specific, but it wasn't the most stable period of my life, I kept no paperwork as things just went straight into the bin, I said if I had a long list in front of me of exactly where all the money has gone I would gladly tell you, the truth is I can't! most of my debt was built up paying living expenses whilst out of work sick, I didn't just go out buying big tellys, new cars or expensive one-off purchases, yet more guffawing and tutting ensued.

    Don't get me wrong, I wasn't expecting it to be a walk in the park, but quite frankly after the whole ordeal he's made me feel like scum. I hope that's the last I hear from him, when at the end he asked if I had any questions I said "yes, can I have your name please?" and there was a slight pause and I only got his surname, then another little pause when I asked him how to spell it, funnily enough his last few words were spoken quite pleasantly.

    I've calmed down a bit but I'm still not very happy with how I was spoken to, Bankrupt or not.

    It could well be the OR was spot on.
    Again, what does the creditors have to do with this? The OR does NOT work for the creditors. Of course they aren't there to mollycoddle those going through BR, who said they did or should? Does that give them the right to be rude? They are there to get the facts and process the BR. They are civil servants and work for the Insolvency Service. According to their own website ..

    "We are committed to providing a professional, fair, efficient, courteous and helpful service to all our users, whether creditors, insolvency practitioners, bankrupts, directors, redundant employees or indeed anyone with whom we have any dealings" http://www.insolvency.gov.uk/howtocomplain/complaininssip.htm

    MrCEO, maybe you should have lead with asking the question about what kind of things the OR said (that upset the OP so much) as opposed to jumping in making the assumption that the OP brought this type of response on themselves.

    Why not tell us his behaviour and we will give you advice on the validity of a formal complaint and to whom.

    They are of course accountable for their actions and behaviour, however, I suspect they are subject to lots of complaints from people who have little or no cause.


    If you have been in the position of having to go br and have the prospect of losing your home etc and having to account for every penny you may have the right to comment. If you have had to suffer the stress and worry and shame of going to court and having a interview with the or you might be in a position to know what you are talking about. If not just go and play somewhere else.
