Debt-write off/ unenforceability

  • Landsker, if you haven't paid or acknowledged the debt in writing since late 2000, it looks as if it is statute barred which means you shouldn't pay anything.

    Drizzly If your cards are pre 2007, they could be UE, but you won't know until you ask for a CCA and check if it is enforceable. If you're credit record is shot already, you don't really have anything else to lose. If they do come back as enforceable, you would then make an arrangement to pay. If they come back as UE, you don't pay, they can chase for the money but without an enforceable agreement, they can't "enforce the debt!, ie take you to court.
