Missing item - seller response

Hello all
just see what you think of this :o
Ordered a toy on 21st aug, its not turned up. Emailed on Sat, no response, emailed again today and got this back.

Hi,
Many thanks for your purchase. We have checked our Royal Mail OBA Proof of postings and according to our records this order was dispatched:
Dispatch Time: 16:00 hours
Date : 23rd August 2010
Weight : 67gms



We would have expected delivery 1 to 2 days later in the UK and 5 to 10 days worldwide.

Before Royal Mails investigation team look at this case 14 days has to elapse from the posting date.

The first thing they will ask is for you to check with your local delivery office to confirm it has not been returned there and either a card has not been left for collection , or the card has been misplaced.

You will need to get the name of the person you have spoken to as a reference, should this case proceed further.

Royal Mail will also ask for you to complete a form as a disclaimer stating that no one else in the property has accepted delivery on your behalf.

They will then investigate this case for us and may send an officer around to see you should they need to make a prosecution for the theft of this item by a member of staff. This is usually a Royal Mail Police liaison officer, who has the power of arrest should they find that this item has been stolen either by a Royal Mail employee or a member of the public.

(This is rubbish right? I've been a seller for 10 years and I've never had this privelege!)

We work very closely with Royal Mail’s anti–fraud department, and help to prosecute anyone guilty of theft.

Hopefully a call to the local office will shed some light on this as it has been known for a packet to be returned following an attempted delivery, but no card being left. Hopefully this is the case, and they can arrange redelivery for you.

If you withdraw your payment from us BEFORE completing this form, we will automatically ask Royal Mail to investigate for non-delivery and theft.

(ie if i open a case...)

    Oh yes, my back went up after the first few lines.

    Personally I would now put in a full paypal chargeback (make sure you open it in paypal) and not communicate further with the seller unless it is via the dispute.

    Sign things, complete this, refund dependent on that...rubbish.

    Total !!!!!!!! . Open a Paypal claim and escalate. After refund consider your FB but don't mention the dispute. I'm sure the Communication DSR won't be 5 star either.

  • I don't know what he thinks he'll achieve with this (massive seller by the way), basically he's passive agreessive, intimidating the buyer into not opening a claim, intimating that every buyer who claims non delivery is a theif!

    Surely you want to discourage the opening of claims to protect your feedback and dsrs, not encourage them?!
    Bonkers, opened a claim and escalated it anyway;)

    Good, I think that email deserved a claim being opened.

    Right, now phone paypal and point out that they have done that and that you consider it a fraudulent attempt to prove delivery. If you say the right trigger words and are persistent enough paypal may well decide for you immediately. They don't like sellers that try and play the system.

    This seller is in cloud cuckoo land! You would think that with that amount of feedback they would know better.

    Then again a lot of new buyers could back off if such a high status seller tries to brow beat them like this.
