DCA Threatening court action- advice need please

Hi Guys.

Originally applied for CCA back in 26 May 2009, (Still no vaild CCA) since then the account has been in dispute.


They passed it onto Moorcroft Debt Recovery Limited, who have been pestering me with letters etc.


Today i receieved a letter from their Pre-Court division. Stating:


" We have been intructed by Barclay Card to collect your overdue debt of xxxxx.

It is a legal requirement to send notice of intended litigation before legal proceedings in the county court are issued. We believe that this letter fulfils this requirement even if it is not actually read by you.

To prevent our recommending to our client that solicitors commence legal proceedings, it is essential that you settle this debt without delay. Payment should be submitted in full within 7 days or contact made with this office immediately......Both our client and we do not wish to take thss action but if agreement cannot be reached by xx/xx/xx. a claim may be issued by our clients solicitors without further notice"


Over the last year or so they have left me alone pretty much until this letter, what do you think guys? Scare tactics?


Barclaycard never produced a valid CCA in the 1st place.

    they can produce a reconstructed agreement. Its likely to be a bluff, but it is barclays so anything could happen

    Before going any further:

    1. Was the a CC?

    2. When was it taken out? On-line or paperwork?

    3. Who did you ask for the CCA?

    4. Did you send a dispute letter?

    5. Do you have a default letter?
    If you've have not made a mistake, you've made nothing
  • Moorcroft are a bunch of muppets. They will hout, bluff and bluster, but it is highly unlikely that they will stumo up the court costs to take this to court.

    3. Who did you ask for the CCA? Asked Barclaycard for the CCA 26 May 2009 (They sent scanned copies of standard terms and conditions, nothing to do with my account)

    standard moorcroft letter they send to EVERYONE! the only difference is the address and account details.

    id state the acc is still in dispute as ur still waiting on the CCA.
